This website, TurtleFluent Merch, is operated by Kon Ventures LLC, a Colorado limited liability company. Throughout the site, "we," "us" and "our" refer to Kon Ventures LLC. By visiting our site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy and Shipping Policy. If you don't agree, please don't use the site.

Our store is hosted on Shopify. Products are produced and shipped by our fulfillment partner, Printful.

1. Eligibility and accounts

You must be at least the age of majority where you live, or have the permission of a parent or guardian, to use this site and place orders. You're responsible for the accuracy of the information you provide and for keeping any account credentials secure.

2. Products and descriptions

Our products are made to order. We try to display colors, prints and details accurately, but colors can vary across screens, and printed or embroidered results can vary slightly from the mockup. Sizes can vary slightly; please use the size chart on each product page.

3. Pricing and payment

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Taxes and shipping are calculated at checkout. We may refuse or cancel any order, including for suspected fraud or errors in pricing or product information; if we cancel after you've paid, we'll refund you.

4. Shipping, returns and refunds

Shipping, delivery estimates, returns and refunds are governed by our Shipping Policy and Refund Policy, which are part of these Terms. Delivery times are estimates, not guarantees.

5. Intellectual property

All content on this site, including the TurtleFluent name and logo, the Bubbles character, artwork, designs and text, is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce or sell it without our written permission.

6. Prohibited uses

You may not use the site for any unlawful purpose, to infringe anyone's rights, to transmit malicious code, to interfere with the site's security or operation, or to scrape or collect data without permission.

7. Third-party links and services

The site may link to third-party websites, including turtlefluent.com. We aren't responsible for third-party content, products or practices.

8. Disclaimer of warranties

Except as expressly stated in our Refund Policy, the site and products are provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Kon Ventures LLC and its members, managers, partners and service providers won't be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to a product won't exceed the amount you paid for that product.

10. Indemnification

You agree to indemnify and hold harmless Kon Ventures LLC from claims arising from your breach of these Terms or your misuse of the site.

11. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules, except where the consumer laws of your place of residence require otherwise.
